A Landlord’s Guide to Gas Safety in Edinburgh

Edinburgh has one of the busiest rental and short let markets in the country, and every landlord has clear legal duties around gas safety. Here is what you need to know to stay compliant and keep tenants safe.

From the student flats of Newington to the festival lets of the Old Town, Edinburgh has one of the most active rental markets in the country. If you let a property in the city, you take on more than a mortgage and a tenancy agreement. You also take on a legal responsibility for the safety of every gas appliance in that home.

Gas safety law is strict, and for good reason. A faulty boiler or fire can put lives at risk, so the rules are designed to protect tenants and to give landlords a clear framework to follow. The reassuring news is that meeting your duties is straightforward once you understand what is required.

Your legal duty as a landlord

By law, landlords must ensure that all gas appliances, flues and pipework they provide are kept in a safe condition. This applies whether you let a single flat, a family home or a room in a shared property, and it applies to long lets and short lets alike.

Meeting this duty means arranging regular safety checks, keeping proper records and using a qualified engineer for any work. These are not optional extras. They are the minimum standard expected of anyone who rents out a property with gas.

The annual gas safety check

You must have every gas appliance and flue you provide checked for safety at least once every twelve months by a Gas Safe registered engineer. After the check, the engineer issues a gas safety record, sometimes still called a CP12, which sets out what was inspected and confirms it is safe.

You are required to give a copy of this record to your tenants, usually within twenty eight days of the check, and to any new tenant before they move in. Keeping to the annual cycle is essential, as letting the check lapse leaves you both non compliant and potentially liable if something goes wrong.

Always use a Gas Safe registered engineer

Any engineer who works on gas appliances in your rental property must be on the Gas Safe Register. This is the official list of engineers who are legally allowed to carry out gas work in the United Kingdom, and it is your guarantee that the person is competent and properly qualified.

It is good practice to check an engineer’s Gas Safe registration card and to keep a note of their details alongside your safety records. A reputable local firm will be happy to show their credentials and to explain exactly what the annual check involves.

Short lets and shared homes in Edinburgh

Edinburgh’s popularity with visitors and students means many properties are let as short term holiday lets or as houses in multiple occupation. These arrangements often bring additional rules on top of the standard gas safety duties, including local licensing requirements for short term lets and extra safety expectations for shared homes.

If you run a short let or an HMO in the city, it is worth confirming your obligations with the council as well as staying on top of your gas safety checks. Keeping every appliance serviced and every record up to date protects your guests, your tenants and your licence.

Keep good records and plan ahead

Organisation is a landlord’s best friend. Keep copies of every gas safety record for at least two years, note when the next check is due, and book it in good time rather than waiting until the deadline is upon you. Booking early avoids the scramble of trying to arrange access at the last minute.

A little planning also helps with tenant relationships. Giving reasonable notice, working around their schedule and providing the safety record promptly all show that you take their wellbeing seriously, which makes for happier and longer tenancies.
